Pink Computer Screens

In July 2010 the Urban Tronic GmbH (“Urban Tronic”) with its place of business in Hannover/Germany concluded with Mr. Andris Quickbuy (“Quickbuy”), a computer dealer in Riga/Latvia, via fax a contract for the delivery of 150 graphicboards for Apple computers together with 150 software-programs specifically designed to enhance the speed of the graphicboards. The parties agreed on a package price of US-$ 150.000,00 to be payable in advance. If sold individually, the graphicboard would sell for US-$ 1000,00. The software-program for US-$ 300,00. The delivery was due in August 2010 and Urban Tronic delivered the goods in time via airfreight to Riga.

When Quickbuy opened up the boxes he realized that 30 graphicboards were not correctly packaged and had suffered damage beyond repair. Therefore he tested the other graphicboards including the delivered software. The testing showed that the remaining 120 graphicboards on their own were working correctly but together with the software just a pink computer-screen appeared, blocking any further work with the computer

Quickbuy notified Urban Tronic immediately about this problem via fax and demanded the delivery of flawless goods or, alternatively, his money back. Urban Tronic, having his money, has not reacted at all.
